Court Silences Kirralie Smith Over Women’s Sports Advocacy
An Australian court has ruled against Kirralie Smith, restricting her advocacy on women’s sports. What does this mean for free speech?
On December 20, 2024, Kirralie Smith was placed under a two-year apprehended violence order (AVO) after an appeal overturned an earlier ruling in her favour. A local magistrate originally denied the application in 2023, but the district court has now reversed that decision.
You can read the ruling here: Blanch v Smith — NSW Caselaw, though many key points remain in dispute.
Let’s set the record straight: Kirralie has never met, spoken to, or even publicly named the applicant. Her advocacy has always focused on Football Australia and other sport governing bodies that allow males to compete in female divisions.
The only reference to the applicant was a publicly available photo — used to demonstrate that males are, in fact, playing in women’s competitions.
This ruling has far-reaching consequences. Words are not violence. Political advocacy is not harassment.
This AVO effectively acts as a gag order — silencing Kirralie and setting a dangerous precedent for anyone who dares to discuss or speak out about the inclusion of males in female spaces, services, and sports.
Ongoing Legal Battles
On February 7, 2025, Kirralie appeared in the Local Court of NSW in a separate matter.
Independent journalist Kat Karena attended and shared her insights. Read her report here.
And the fight isn’t over. On April 14, 2025, Kirralie will face another legal battle — a vilification case brought by Sydney soccer player and trans activist YouTuber, Riley Dennis. The hearing will take place at Downing Centre in Sydney. If you’re able to attend, please show your support and remain respectful and quiet at all times.
This relentless lawfare is draining time, energy, and financial resources. The process itself has become the punishment.
The applicants in both cases benefit from pro bono legal representation. In one case, taxpayer-funded legal services from the government-backed Inner City Legal Centre are being used to repeatedly target Kirralie for her political speech. In another, the global law firm Dentons — a firm that receives massive government contracts — is working to stifle her advocacy.
Meanwhile, every dollar of our side of this battle needs to be raised.
Kirralie is on the front lines, fighting not just for herself, but for all Australians who refuse to be silenced. To date, legal costs have reached nearly $200,000 — and we still have a long road ahead.
This isn’t just about Kirralie or Binary Australia. If these activists succeed, they will set a precedent that allows the silencing and punishment of anyone — politicians, journalists, and everyday Australians — who dares to challenge their ideology.
This case is about protecting free speech and political advocacy in Australia. Kirralie is standing strong — but she needs your support.
Thank you for being part of this fight.

Most Australians still believe in human dignity and inalienable rights, essential truths for a just legal system. What they’ve since abandoned is the only foundation that make those beliefs coherent.

Lyle, thank you so much for bring this travesty of justice to our attention. I would encourage anyone reading your piece, Lyle, to re-post it everywhere they can, talk about it whenever they can and pray about it however they can. Kirralie is a magnificent soldier in the army of common sense, she is a voice for the voiceless, she is such an inspiration to us all.
I am ashamed to be an Australian when I see under the law supposed to be equal and fair for all. A woman fighting for her right to have biological women only in sport and having to pay her own court costs, while the applicant is fully covered by Government funding. It is obvious to me it’s time we had a change of Government. Let us women of Australia have our say at the poll and support Kirralie the magnificent soldier in the army of common sense to get rid of such nonsense from our land and our country.
Joy, well said. I can’t help thinking back a week or so to hear Trump establishing biological fact for all the world to see while calling out the male thug who dismantled the career of a great female athlete. The Australian judiciary have been bought by a vocal minority and we need to claim it back.
It’s unbelievable that this sort of rubbish should even be entertained in Australia. Men are men and women are women and that’s it. Good on you Kiralle and Lyle and all the rest who are stating the obvious. May we all have the courage to do so.
