NZ Court Rules Defence Force’s Covid-19 Vaccine Mandate Unlawful
The New Zealand Defence Force must reassess its injection mandate and pay court costs for the four successful appellants.
The New Zealand Court of Appeal has ruled that it was unlawful for the nation’s Defence Force (NZDF) to compel Covid-19 injections upon its service members.
Issued late on Friday, the judgement ruled in favour of four unnamed members of the armed forces who faced possible dismissal from the NZDF for refusing the experimental therapy.
The justices hearing the case found that, while the NZDF had the right to add Covid-19 vaccinations to its schedule, the consequences of the workplace mandate were disproportionate and constituted a breach of rights against service members.
Specifically, they noted that the Defence Force failed to prove that the mandate was necessary to maintain the efficacy of New Zealand’s Armed Forces.
“The respondents have not demonstrated that the more stringent and prescriptive consequences brought about by the TDFO for not having these particular vaccinations is justified. In particular, the respondents have not shown that the ongoing efficacy of the Armed Forces could not have been ensured by less rights-limiting measures along the lines identified by the appellants,” the judgment read.
The Defence Force Chief has been ordered to reassess the force’s medical mandate in light of the ruling. Along with other respondents, the Chief has been ordered to pay all court costs to date in a lawsuit that began last April.
The respondents have an opportunity to appeal to New Zealand’s Supreme Court, but only under certain conditions and at the discretion of the nation’s highest court.
Fake News Media Silent
New Zealand’s Deputy Prime Minister Winston Peters welcomed the decision, writing on X, formerly Twitter:
New Zealand First campaigned on and fought for the removal of any and all remaining workplace mandates being enforced, and we ensured it was included in our coalition deal with National.
This ruling by the Court of Appeal is evidence that it is the right and just thing to do to get rid of these remaining mandates.

New Zealand’s fake news media, which used its reach to aggressively promote compulsory injections, has remained conspicuously silent on the ruling.
One of the few outlets to report on the story is independent outlet Rebel News, whose chief reporter Avi Yemeni noted the glaring irony, and took particular aim at the New Zealand Herald.
“Why is the msm [mainstream media] IGNORING this story?” He asked on X.
“Even the @nzherald, which published article after article trying (and succeeding at first) to have me banned from the country, hasn’t reported a thing about this bombshell ruling.”
“Surely my trip to New Zealand wasn’t more newsworthy.”

Alarming Data From Stats NZ
The ruling came just days before New Zealand’s bureau of statistics, Stats NZ, released new data revealing that the nation’s fertility rate has now reached the lowest on record, while deaths for 2022 and 2023 are the highest on record.
Stats NZ confirmed that life expectancy in the nation has dropped on previous years, while the number of live births has also fallen to the lowest level in 20 years.
