Kirralie Smith Fined $95,000, Forced to Apologise for Calling a Man a Man
A New South Wales Local District Court has fined Kirralie Smith $95,000 for so-called ‘misgendering’.
The civil penalty includes a forced public apology for refusing to refer to a man as a woman.
Smith shared some of the details on social media earlier today, stating that the “fines will be $190,000 if not paid within 28 days.”
Defiant, the Australian Binary director said she would be appealing the decision.
“It is disappointing that the word ‘woman’ has been redefined to include males,” Smith stated.
We now have the “words ‘violence’ and ‘vilification’ being applied to speaking the truth about information in the public domain.”
“Australians should be very concerned about their freedoms,” Kirralie warned.
Kirralie has been fined $95k for refusing to call a man a woman.

Court Determines ‘Misgendering’ Is Violence
Leaning on the outcome of her case, she added,
“Women have effectively been erased from law, and attempts to advocate regarding public policy are shut down for the sake of the feelings of a few.”
“Males should never be permitted to participate in female sport,” Smith protested.
“As a registered third-party political campaigner and a woman, I should have the right to advocate for this without being penalised.”
There’s a dangerous precedent here, she exclaimed.
The “decision, alongside the High Court’s denial to appeal against the apprehension of violence order,” she said, “sets a precedent that all journalists, politicians, and political advocates must take note of.”
“The law might state men can be women, but it defies the laws of nature and cannot be sustained.”
“Nothing,” Smith exclaimed, “will steal my joy in knowing that I am a woman and no male ever will be.”
“I am proud to stand for truth and reality.”

Kirralie also thanked supporters, stating that their “voice and your action were invaluable to her.”
As extensively reported by The Daily Declaration team, Smith has effectively been punished for violating LGBT “biology-is-bigotry” laws.
This is what the slow death of free speech at the hands of forced speech looks like.
Smith’s point is justified. The battle for biological truth is not just hers to fight alone.
The battle will eventually involve every Australian because this is a “fight for truth and reality itself.”
“If I can be found guilty of vilification for speaking the truth, so could you,” Smith asserted in an X post in early November.
“So could journalists,” she added.
“So could politicians. So could anyone who refuses to bow down on the altar of any radical ideology.”
School Teacher Imprisoned in UK, Canadian Pastor Arrested
Kirralie’s civil penalty for so-called misgendering comes just a day after former Irish school teacher Enoch Burke was imprisoned for similar reasons.
Burke will spend the rest of his life in prison for as long as he refuses to stop protesting outside his former school.
The Christian educator took up the non-violent protest after being fired for “gross misconduct” in 2023 after refusing to use a student’s “preferred pronoun.”

Kirralie’s massive fine and forced apology also coincides with the arrest of Canadian Pastor Derek Reimer.
As reported by Caldron Pool editor Ben Davis, Reimer was detained for refusing to give a “written apology to a public librarian over hurt feelings.”
The incident related to Reimer protesting a “Drag Queen Story Time event for children.”
CP said Reimer was charged with “criminal harassment” based on what he called a “fabricated narrative.”
In Reimer’s case, the Librarian’s feelings appear to have been viewed by the court as fact.
‘Kirralie Is Being Vilified’
Both the Burke and Reimer cases support Kirralie’s concerns about forced speech precedents.
Responding to news of Smith’s civil sentencing, Giggle CEO Sal Grover wrote,
“It is always important to remember that every claim made by gender ideology, the exact opposite is true.”
“It’s Kirralie who is being vilified.”
Women’s Forum Australia director, Racheal Wong, declared the decision an “absolute disgrace.”
“Fining a woman nearly $100,000 for saying men aren’t women doesn’t change the fact that men aren’t women.”
To paraphrase Kirralie’s response to The Daily Declaration, “let’s make the madness of ‘misgendering’ front-page news!”

This is not acceptable, a man is a man whatever the individual may think, biologically there is no argument, it is what it is.

The common law and the freedom it encompasses have a constitutional dimension. It has been referred to in this Court as the ultimate constitutional foundation in Australia.
A very sad day indeed. Kiralee has done nothing other than state what is a biological fact. No amount of hormone therapy, surgical intervention of changes to the law can change the genetic code we are all born with. Where does the Liberal Party and the National Party stand on this issue now? Anyone able to inform us please?
Until recently in Australia I never thought you could be given a huge fine for believing in biology or that biology would become hate speech. Will all the biology teachers end up getting fined too?
How can these law people sleep at night? My feelings are “hurt” that Kirralie and others have to go through this hell while real criminals maybe get a reprimand. Also what a waste of resources in these days of enormous debt. Kirralie, you are a real Esther. Our Lord stands with you, as do many.
Why not support Kirralie buy stepping out of our comfort zone and proclaim ” That men are not women and women are not men ” and put ourselved beside Kirralie putting extreem pressure on the courts and goverment to stop this foolishness.

Marg, excellent point. My concern is that the majority of Austrians still believe the courts uphold and stand for justice. Sadly they have been turned into indoctrination enforcement instruments; and has Harrison questions, how can the ‘legal people’ sleep at night now, when they have to peddle such fairy tales.

My heart and thnaks go out to Kirralie and my prayers go up for her to stay strong and to be allowed justice. This new step of penalising of Kirralie for her stand for a Christian/Biblical definition of humans beings, as male and female, is a very sad comment on how our society has declined into ‘lawlessness’ where right and wrong are no longer defined by past categories (eg male and female categories were in the Judeo-Christian constitution in 1901.)
The fact she is not trying to offend anyone else but is trying to stand on the foundational truths of what the nation was built on. May God forgive those who wish to persecute her for simply standing on the foundation that was once agreed to, according to God’s word and the sake of a stable society.
(It is interesting that countries like China, Russia and Iran and the Middle East stand in favour of male and female categories, even though they are not Christian nations -they want stability and structure and don’t allow any tampering of their laws regarding gender to take place)
