
Gender Identity Lawfare: No One is Safe
Politicians could resolve gender identity issues in an instant.
Since 2019, Binary has been calling for a reinstatement of the definitions of male and female into the Sex Discrimination Act (SDA).
So far, only a handful of politicians, and none in power, have even acknowledged the problem.
Julia Gillard’s government removed the definitions in 2013, making way for gender identity to take precedence over reality in law.
At that moment, women’s sex-based rights were erased with the stroke of a pen.
Truth Censored
Even prior to the same-sex marriage legislation being enacted, many of us warned that if we redefine the word “marriage”, it would be inevitable that other words would be redefined.
And here we are with the word ‘woman’ now including males, and the words ‘violence’ and ‘vilification’ being broadened to mean truthful speech that makes a small cohort of society feel uncomfortable.
This is more than a free speech issue; it is a truth speech issue.
If we cannot speak freely, with the backing of evidence-based scientific facts, how can anyone know if their speech falls foul of vilification or apprehension of violence laws?
You can now be held responsible for someone else’s feelings that are not definable or measurable.
If Binary, as a registered, third-party political campaigner, cannot speak freely about public policy, what makes you think journalists and other political actors can?
The laws used against me can be used against them. And you.
How do you know what you can and can’t say?
If hurt feelings and self-proclaimed fears, not backed by any evidence, are enough to penalise opponents in law, we are all doomed.
If the lines are not defined or measurable or standardised, the law hangs over every person’s head as a warning to remain silent or else.
If sex were defined in the SDA, then all of the following would never have been penalised in the first place.
Sall Grover, Lyle Shelton, Dr Jillian Spencer, Jasmine Sussex, Moira Deeming, Katherine Deves and many more would just be living life and going about normal business.
Instead, we have all had to spend time and energy defending the reality that sex is binary.
With these bad laws that deny reality, no one knows who will be next to be dragged through this logic-defying process.
I sincerely hope it is not you, but unless we put enough pressure on the political class to change the laws, no one is safe.
Sex Discrimination Commissioner makes a fool of herself again
Australia’s Sex Discrimination Commissioner cannot define the word “sex” or the word “woman”.
Dr Anna Cody is paid hundreds of thousands of taxpayer dollars each year, but she cannot define her own portfolio. Is there anything more embarrassing?
Perhaps her recent speech at the National Press Club sums it up. She has zero regard for the sex-based rights of women, the reason why the Sex Discrimination Act was written in the first place. Instead, she wants men protected at the expense of all women.
When we talk about gender equality, we must be clear that means equal treatment of all genders, including trans and non-binary people. Around the world, we’re seeing gender diversity being used as a weapon for ideological and political purposes. This is particularly unjust when it targets a group that already faces high rates of violence and makes up less than 1% of the population.
When we affirm and support a person’s identity, we reduce the risk of them being treated unfairly in everyday situations like walking down the street, applying for jobs, going to the doctor, or traveling. We reject the stigma that says trans people must hide who they are to be safe or accepted. When we recognize trans rights, we recognise the worth and dignity of every person.
We need urgent and coordinated action from all levels of government, state, territory, and federal. That includes ongoing funding for consistent and inclusive education that’s based on evidence covering relationships, consent, and sexual and reproductive health.
Read that line again: “When we recognise trans rights, we recognise the worth and dignity of every person.”
What absolute rubbish. What are ‘trans rights’ exactly? The right to trample over female sex-based rights does not recognise the worth and dignity of every person at all.
The commissioner goes on to state that men can be women and the government must work harder to silence those of us who speak the truth about biological reality.
So CEDAW has been interpreted and understood to include all women if that’s what you’re getting at. Um that certainly the convention on the elimination of all forms of discrimination against women. So CEDAW is absolutely it’s the women’s convention. But in understanding as we have developed it was signed back in 1979 I believe. um since it’s been in force in Australia, it has also been interpreted by the committee that looks at the meaning and the understanding of each of the articles of the convention.
So that includes and it is specifically said it includes culturally racially marginalized women, it includes uh lesbians, it includes um first nations women, women with disability and trans women. So it absolutely includes all women because that is who women are. We’re not one version of women and so that’s why it has to be an inclusive definition of women.
