Nationals MP Alison Penfold Launches Bold Bid to Repair Australia’s Broken Woke Sex Discrimination Law

Nationals MP Alison Penfold has launched a bold push to restore biological sex definitions to Australian law, reigniting debate over women’s rights, legal clarity and gender ideology.

Nationals MP Alison Penfold has aligned the House with One Nation’s Senate bid to repair Australian law.

Like One Nation, the fiery Wauchopian wants the terms “man” and “woman” put back into Australia’s Sex Discrimination Act.

Julie Gillard, who only became Prime Minister thanks to three independents, “transed” the law in 2013, erasing binary gender and replacing it with “gender neutral” ambiguity.

Gillard also booted the phrase “opposite sex” and replaced it with the vague diversity, equity and inclusion (DEI) term “different sex”.

Reversing Gillard’s 2013 Amendments

Proposing clarity, Alison Penfold is braving the inevitable trans hate and “homophobic” slurs in a bid to have the law reassert biological reality.

The MP submitted her Sex Discrimination Amendment (Sex-Based Rights) Bill 2026 to the House of Representatives yesterday, stating,

“When the law cannot clearly preserve women-only spaces, women lose confidence that their rights to privacy, dignity, safety and choice remain secure.”

“That is not a criticism of the court. The court interpreted the law that this parliament wrote. The fault lies here,” thundered Penfold.

In other words, parliament should fix the legislation it broke.

Acknowledging the victims of Gillard’s “progressivism”, Penfold described Sall Grover, Dr Jillian Spencer, Louise Elliott, Jasmine Sussex and Kirralie Smith as “women of immense courage.”

“These women did not seek fame. Many paid a significant personal and professional price for speaking out.”

“Yet they persisted because they believed women and girls should not be forced to stay silent,” she said.

Penfold, a Christian, also acknowledged the work of Alex Antic and Nationals boss Matthew Canavan.

Offering full transparency, she added that the proposal was formed with the assistance of the Australian Christian Lobby and the Human Rights Law Alliance’s John Steenhof.

“Biological Reality” Back in Law

The bill, Penfold stated, “seeks to restore clarity, certainty and common sense to the law.”

Her proposition is simple:

“The law must recognise and favour biological reality, because laws only function properly when they are grounded in objective facts that can be consistently understood and applied.”

“Biological sex is not a social construct created by parliament.”

“It is not a matter of personal opinion. The role of the law is not to deny reality. It is to responsibly govern within it.”

To this, Penfold declared,

“That does not mean transgender Australians should be treated without dignity or respect.”

However, “Australians are practical people, and they do not like being told the law says something that goes against plain common sense: that a man can become a woman for all legal purposes.”

Or, “that biological differences are irrelevant; that sex itself is fluid.”

“Australians know instinctively that men and women are equal in dignity and worth, but they also know that biological sex still matters in some circumstances.”

“Recognising that reality should not be controversial,” Penfold said.

“This bill provides the legal clarity that this parliament failed to provide 13 years ago.”

“And importantly,” the Member of Lyne argued, “it does so while retaining protections for transgender Australians against unfair discrimination where there is no conflict with a person’s sex.”

“That is important,” she clarified, “because there will inevitably be those who seek to falsely portray this bill as an attack on transgender Australians. It is not.”

“The current Sex Discrimination Act has imposed confusion and chaos on many Australians.”

“Women are prosecuted for denying biological men lessons in breastfeeding,” Penfold explained.

“Our language is defeminised. [Women] now ‘chest feed’,” she recounted.

“We are a ‘birth parent’, a ‘pregnant person’ or a ‘lactating parent’. We are now ‘people who menstruate’ and ‘cervix havers’. We have a ‘front hole’ instead of a vagina.”

Further defending both the necessity and urgency of repairing the law by restoring XX and XY biology to it, Penfold said,

“Our institutions are making decisions not because the law is clear but because they fear litigation and public backlash.”

“That is not good lawmaking,” she asserted.

“A liberal democracy cannot function properly when ordinary people become afraid to speak plainly.”

“Nor can it function when parliament refuses to confront difficult issues honestly.”

To correct the Gillard-era surrender to political correctness, Penfold’s bill will reverse the changes without removing “gender identity protections”.

For example, the terms man and woman would be reinstated with an emphasis on basic biology: what a man is, and what a woman is, as defined by sex chromosomes.

Additionally, Penfold’s proposal will reinstate “opposite sex” and ditch “different sex”, the former’s 2013 replacement.

Contrary to complaints from LGBTQ+ lobby group Equality Australia, who’ve already written the bill off as “anti-trans”, “gender identity” and “sexual orientation” remain.

Without defining what a woman is, the LGBTQ+ group, which just gained a one-of-a-kind special tax status from Labor, “slammed” Penfold for pushing “division,” and trans identifying people out.

EA effectively called the bill a permission for persecution. Labelling it a “culture war” on Queer ideology, they bizarrely claimed that Penfold’s proposals would also “set women’s rights back to the dark ages.”

A Defining Test for Conservatives

Welcoming the bill, Women’s Forum Australia CEO Racheal Wong said, “The speech was excellent.”

“Every federal politician must work to get this done!”

Kirralie Smith, who has spent the last two days appealing the consequences of this broken law, simply stated, “Thank you to my local MP who is getting the job done!”

HRLA’s John Steenhof applauded Penfold’s bravery, then warned that this will “be a big test for Liberal convictions. The worst hivemind pollies on trans ideology are in the Liberal Party, not Labor.”

Not overly optimistic the Liberals would pass the Penfold test, he cautioned,

“Libs will find some way to decide this Bill takes the wrong approach or is either too much or not enough or has some minor flaw.”

“Whatever it takes not to support the Bill while professing genuine conservative convictions.”

He then stated, “I hope I’m wrong.”

Penfold’s brazen speech doesn’t just signify solidarity with female victims of the Gillard amendments, such as Sall Grover and Kirralie Smith.

Its sparks could ignite a significant socio-political cultural shift.

Penfold is right to state that this isn’t a culture war. Her bill is every bit a solid attempt to neutralise one.

A culture war, which, despite the DARVO from Equality Australia, is being waged against the West because of the bureaucratic free ride for far-left activism.

Hopefully, Penfold’s bill embodies the beginning of the end to that activist takeover of the judiciary and marks the start of removing LGBTQ+ lawfare from Australian courts.

Even if nothing else is achieved here, at the very least, Penfold has put the trans takeover of female-only spaces on notice.

    A brilliant Speech by Alison Penfold MP. Both she and I do not blame the judiciary for court decisions which have caused such personal harm and financial distress to a number of courageous women because the judiciary must uphold the Law no matter how stupid and /or evil it is ! The fault, as Alison Penfold MP rightly says, rests fair and square with Parliament . She has given Albanese 2 options— (1) to back her Private Member’s Bill to amend Julia Gillard’s The Sex Discrimination Act 2013 ( which he supported ), or, (2) to have a full Enquiry into its operations. She has the backing of MPs from various Parties. It is noted that the Liberal Party ( apart from Sen. Antic ) has been pro the current Act and hostile to its amendment. I suspect it is the usual LNP male and female MPs ( left overs from the Turnbull Govt ) who should have been dis- endorsed aeons ago which is why the public has left the LNP to join One Nation.
