Senators Re-Introduce Crucial Bill to Protect Babies Left to Die Each Year

Three Australian Senators have re-introduced a Bill to protect babies who survive an abortion attempt, are born alive and left to die. The multi-party effort comes after the original Bill lapsed following the resignation of its previous sponsor, George Christenson.

On the 30th of November, senators from three different states and three different parties — Alex Antic (Liberal Party, South Australia), Ralph Babet (United Australia Party, Victoria) and Matt Canavan (Liberal National Party, Queensland) — introduced the Human Rights (Children Born Alive Protection) Bill 2022 into the Australian Senate.

According to its authors, the Bill will seek to “ensure that a child who survives an attempted termination of pregnancy will be entitled to the same level of medical care and treatment as any newborn child.”

Presumably, this kind of care would be uncontroversial and already in place. However, the official Queensland Health guidelines currently advise doctors and nurses to “not provide life-sustaining treatment” when a “live birth” occurs (page 24). They are simply to record the “date and time end of life occurs”.

why we need Born Alive Bill

In his Second Reading speech in parliament, Senator Canavan outlined the rationale for the bill:

“Let me be clear: I am pro-life. I think abortion is an evil. It results in the death of a child and often ongoing mental harm for a parent. I would rather no child be aborted in this country or elsewhere. But whether you are pro-life or so-called pro-choice, I do not know that anyone, but the most cold-blooded sociopath, who could say that a child born alive is not a child and thus does not have any rights.

The Human Rights (Children Born Alive Protection) Bill 2022 seeks to place a duty of care on medical practitioners to provide exactly the same medical care and treatment to a child born alive as a result of an abortion as they would a child born in any other circumstances.”

Coverage and Responses to the Bill

While the coverage from legacy media outlets has been predictably non-existent, the response on social media was powerful, with hundreds commenting on the senators’ posts thanking them for their stand.

The Hon. Bernie Finn MP, the leader of the Democratic Labour Party in Victoria, thanked Senator Canavan for introducing the Bill, calling him a “champion”.

In a brief interview after the announcement, Dr Joanna Howe, an Associate Professor in Law at the University of Adelaide, thanked Senator Antic for helping to introduce the Bill, calling it a “courageous” move.

“… it doesn’t matter if you’re Labor, you’re Liberal, you’re UAP. We’re all human beings, and so we should all care about the legal rights and human rights of babies.”

“I think probably most Australians actually don’t even know that babies are born alive and have no legal rights under Australian law. So in Victoria, in Queensland, in the last ten years, 724 babies have been born alive and, I hate to say this, but actually left to die. Like, they’ve got no rights to medical treatment, no rights to palliative care … and so I just think this bill is so important.”

In the video, Senator Antic urged people to start writing to their senators asking them to support the Bill.

Senator Canavan finished his Second Reading speech with the chilling words:

“The question of whether or not this Bill is supported will be a test of the true measure of not only this chamber, or this parliament, but of our society.”

The Original Babies Born Alive Bill

In 2021, the Bill was initially introduced to the House of Representatives by the then-member for Dawson, George Christenson. However, due to Christenson’s resignation, the Bill lapsed. Hence, its reintroduction into the Senate.

Back in 2021, prominent pro-life organisations like FamilyVoice Australia, Cherish Life Queensland and Right to Life Australia voiced their strong support for the legislation.

Unfortunately, neither the then Coalition government nor the Labor opposition had been favourable to the Bill. A spokesperson for the Minister for Health in the Morrison Government had fobbed the Bill off as a “state and territory responsibility”.

The then opposition was no more favourable.

Despite the fact that data from the Parliamentary Library shows that at least thirty-three babies were born alive in Victoria in a single year (according to Canavan, the figure was 204 in Queensland over a ten-year period), Labor member Meryl Swanson chose to question the “factual basis for the central claims Mr Christensen has made”.

As Senator Canavan pointed out, one child’s life saved through this legislation would make it worth passing.

“Others have claimed that this bill perpetuates a myth that children are born alive a (sic) result of abortions. The data available via the Parliamentary Library shows that to be a false claim, but even if that claim was correct — which it is not — what harm would this bill do? If no viable child is ever born alive as a result of an abortion, then this bill has no effect.

But if one child, just one, was born alive in such circumstances and that child was viable then this bill would not only have an effect, but it would be more important than probably most laws on the books because it would save a life that otherwise would have been discarded like it was medical waste.”

As Senator Antic stated, consider emailing, meeting with or phoning the senators in your state to voice your support for the Human Rights (Children Born Alive Protection) Bill 2022.

    A short time ago I thought I was alone in not, understanding what actually happens to both unborn baby and mother during an abortion. Now I know that once again I was wrong. Most do not.
    Please anyone who can – make a Parliamentary Submission by December 15th ?

    My heart breaks after reading this barbaric practice. The life of a newborn is a precious gift from God. Thank you Senators for putting this bill forward. i will be praying in support .

    Praise God for you 3 protectors and lovers of life.
    I am praying for those in Government, and the Doctors and nurses who allow this murder to happen. If they do not repent, can you imagine the wrath of God toward them when they stand before Him and have to give an account on judgment day for what they allowed to happen to God’s children?

    These guys are legends, they need our support but much more, the babies left to die. How can we accept it is ok to wrap an aborted baby in a warm blanket, and give it to the mother until it dies??? How far has society fallen?

    I just took part in a ‘Community Consultation’ survey about the West Australian: Human Rights (Children Born Alive Protection) Bill 2022 ~ which had questions that quibbled over the number of months’ gestation that one thinks is an acceptable death sentence for an unborn human being!!
    How repugnant to put that in a survey, and in 4 or 5 differently worded repeats ~ I stated that It was just vile barbarism to put any time limit on the life of an unborn human being, and the term they used: “Abortion care” is no ‘care’ for the one to be killed, and only deceptive semantics to remove any ‘option’ for the life and safety of the unborn in that “Survey”. It conveyed no empathy or regard for the well-being of the unborn – as if psychopathy is the norm in our ‘modern’ heartless society.

    What kind of a culture and society voices more concern for the lives and safety of rats and mice used in testing products, while remaining mute and apathetic about the huge, continuing numbers of human babies killed off in abortions – for the convenience of people who didn’t avail themselves of easily available contraception?

    Thank you for this interview Cody and the 3 courageous senators, and Dr Joanna Howe (professor or Law SA) who have fought for the rights of the unborn and shown how desperately a bill is needed to protect all unborn life – the innocent lives who cannot speak for themselves.
    It remains a great shame that Australia has lost 724 babies in the last 10 yrs due to the lack of protection for those aborted, or who were allowed to waste away and die after birth- even when it was full term. It is a crime against humanity and the helpless ones who have no voice and who need our Government to protect them.
    May God gather up those who will stand with the unborn, write submissions, contact Senators and MPs and pray for the protection of the unborn who have a right to live and were created to live and breathe and grow up to live a full life. These are Gods creation and are to be cherished. Even if people hold the view of evolution or some other belief, this is still a precious child who has right to live and not be killed early.
    Even America has woken up to the fact that it was illegal and unconstitutional to kill babies in the womb or to let them die, so they have reversed the Roe and Wade law and now protect the unborn.
    May God have mercy on Australia and help many see how far we have slid down the slippery slide of convenience. May we take up the responsibility of caring for the unborn and help get to homes where they are wanted and loved. We need to really face this grave situation and to help get the bill passed.

    Thank God for the senators reintroducing this bill. The mere fact though that it should be necessary to have this enforced in law shows the decadence to which Australia has fallen; and most people just aren’t even aware of the extent of it.

    Cody, thank you for bringing this barbaric practice to the light. All my life (adult life I guess) I have simply been challenged by the ever increasing number of ‘weeks’ when abortion has been ‘permitted’. This challenge is totally ‘at another level’. How can any ‘genuine’ medicinal professional ‘sign off’ on this practice? It simply illustrates that ‘something pure demonic’ has made itself in our society. Lets get this story as much ‘air time’ as possible. Lets ensure that everyone we know and even those we don’t know know about this, darkness cant survive in the light.
    These great senators are my heroes! They are so invaluable, they are the sand grains in the oyster of Canberra. Lets write them as often as we can with our support and encouragement. Shalom, Jim
